The manufacturer warrants the original purchaser only that its TUB and TUB/SHOWER units together with their component parts are free of defects in material and workmanship for a period of five years from date of receipt. There is a three-year separate warranty on whirlpool pump and jets. If during these time frames, any part or Unit fails because of defective workmanship, the original purchaser must promptly notify jjMarketing, Inc in writing, attention Quality Control Manager, at the address below within the applicable time period. The manufacture will then send a representative to examine the Unit. If the examination, in the sole judgment of the manufacture proves that any part of the Unit has failed because of defective material or workmanship, The Manufacture will, at its option, either repair or exchange the part without charge to the original purchaser. The exchange of a Unit is limited to supplying a replacement part or unit of comparable size and style and does not include any cost of removal or installation. The foregoing is in lieu of any and all remedies with regard to the warranted item, and constitutes the exclusive remedy for breach of the foregoing warranty.

EXCEPT AS PROVIDED ABOVE, THERE IS NO OTHER WARRANTY, EXPRESSED OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING WARRANTY IS LIMITED TO THE TIME PERIODS AS NOTED ABOVE FROM THE TIME OF RECEIPT. IN NO EVENT SHALL BATHEASE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF USE. WHILE THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.
